欧盟《数字市场法案》(DMA)译文

第四十九条 授权的行使

1.授予欧盟委员会的授权法案制定权,受本条所列条件约束。

2.第三条第6款、第7款以及第十二条第1款、第3款、第4款规定的授权法案制定权,授权期限自2022 11日起为期5年。委员会应在该5年期限届满前不晚于9个月提交授权情况报告;如欧洲议会或欧盟理事会未在每个期限届满前3个月内提出反对,授权期限默示等额延长。

3.欧洲议会或欧盟理事会可随时撤销上述授权,撤销决定自《欧盟官方公报》公布次日或载明的更晚日期生效,不影响已生效授权法案的效力。

4.委员会在通过授权法案前,应按照2016 41日《良法制定机构间协议》,咨询各成员国指定专家。

5.授权法案通过后,委员会应同时通报欧洲议会和欧盟理事会。

6.上述授权法案需在通报后个月内未遭欧洲议会或理事会反对,或两方均提前告知无异议后方可生效;应欧洲议会或理事会请求,该期限可延长 个月。

第五十条 委员会程序

1.欧盟委员会由数字市场咨询委员会提供协助,该委员会适用(EU) 第 182/2011 号条例规定。

2.援引本款时,适用(EU) 182/2011号条例第四条咨询程序;书面程序征求意见时,若主席决定或委员会简单多数成员请求,程序可无结果终止。

3.援引本款时,适用(EU) 182/2011号条例第五条审查程序

4.委员会应将咨询委员会意见随个案决定一并送达相对人,并在兼顾职业保密前提下与决定同步公开。

第五十一条 (EU) 2019/1937 号指令的修订

(EU) 2019/1937 号指令附件第一部分J点中,新增:

(iv) 欧洲议会和欧盟理事会2022 14 日第2022/1925号条例(数字市场法)(OJ L 265, 21.9.2022, p.1)。

第五十二条 (EU) 2020/1828 号指令的修订

(EU) 2020/1828 号指令附件一中,新增:

第五十三条 评估

1.欧盟委员会应不晚于2026 53日启动首次评估,此后3年开展一次,向欧洲议会、欧盟理事会、欧洲经济和社会委员会提交评估报告。

2.评估内容包括:数字市场可竞争性与公平性目标实现情况、对商业用户(尤其中小企业)和终端用户的影响,并专门评估第七条适用范围是否可扩展至在线社交网络服务。

3.评估应研判是否需修订规则(含核心平台服务清单、第五至七条义务及执法规则),评估后委员会可采取包括立法提案在内的适当措施。

4.成员国主管当局应向委员会提供报告编制所需的相关信息。

第五十四条 生效与适用

1.本条例自《欧盟官方公报》公布后第20 日生效,2023 2日起全面适用。

例外适用节点:

2.第三条第6-7 款、第四十至五十条:2022 年 11 月 日起适用;

第四十二、四十三条:2023 年 月 25 日起适用;若该日期早于 2023 年 月 日,则顺延至 2023 年 月 日适用。

3.本条例全文具有约束力,在所有成员国直接适用。

Article 49

Exercise of the delegation

1.

The power to adopt delegated acts is conferred on the Commission subject to the conditions laid down in this Article.

2. 

The power to adopt delegated acts referred to in Article 3(6) and (7) and Article 12(1), (3) and (4) shall be conferred on the Commission for a period of 5 years from 1 November 2022. The Commission shall draw up a report in respect of the delegation of power not later than 9 months before the end of the five-year period. The delegation of power shall be tacitly extended for periods of an identical duration, unless the European Parliament or the Council opposes such extension not later than 3 months before the end of each period.

3. 

The delegation of power referred to in Article 3(6) and (7), and Article 12(1), (3) and (4) may be revoked at any time by the European Parliament or by the Council. A decision to revoke shall put an end to the delegation of the power specified in that decision. It shall take effect

the day following the publication of the decision in the Official Journal of the European Union or at a later date specified therein. It shall not affect the validity of any delegated acts already in force.

4. 

Before adopting a delegated act, the Commission shall consult experts designated by each Member State in accordance with the principles laid down in the Interinstitutional Agreement of 13 April 2016 on Better Law-Making.As soon as it adopts a delegated act, the Commission shall notify it simultaneously to the European Parliament and to the Council.

6. 

A delegated act adopted pursuant to Article 3(6) and (7), and Article 12(1), (3) and (4) shall enter into force only if no objection has been expressed either by the European Parliament or by the Council within a period of 2 months of notification of that act to the European Parliament and to the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object. That period shall be extended by  

2 months at the initiative of the European Parliament or of the Council.

Article 50

Committee procedure

1. 

The Commission shall be assisted by a committee (‘the Digital Markets Advisory Committee’). That committee shall  

be a committee within the meaning of Regulation (EU) No 182/2011.

2. 

Where reference is made to this paragraph, Article 4 of Regulation (EU) No 182/2011 shall apply.Where the opinion of the committee is to be obtained by written procedure, that procedure shall be terminated without result when, within the time limit for delivery of the opinion, the chair of the committee so decides or a simple majority of committee members so request.

3. 

Where reference is made to this paragraph, Article 5 of Regulation (EU) No 182/2011 shall apply.

4. 

The Commission shall communicate the opinion of the committee to the addressee of an individual decision, together with that decision. It shall make the opinion public together with the individual decision, having regard to the legitimate interest in the protection of professional secrecy.

Article 51

Amendment to Directive (EU) 2019/1937

In Point J of Part I of the Annex to Directive (EU) 2019/1937, the following point is added:‘(iv) Regulation (EU) 2022/1925 of the European Parliament and of the Council of 14 September 2022 on contestable and fair markets in the digital sector and amending Directives (EU) 2019/1937 and (EU) 2020/1828 (Digital Markets Act) (OJ L 265, 21.9.2022, p. 1).’

Article 52

Amendment to Directive (EU) 2020/1828

In Annex I to Directive (EU) 2020/1828, the following point is added:

‘(67) Regulation (EU) 2022/1925 of the European Parliament and of the Council of 14 September 2022 on contestable  

and fair markets in the digital sector and amending Directives (EU) 2019/1937 and (EU) 2020/1828 (Digital Markets Act) (OJ L 265, 21.9.2022, p. 1).’

Article 53

Review

1. 

By 3 May 2026, and subsequently every 3 years, the Commission shall evaluate this Regulation and report to the European Parliament, the Council and the European Economic and Social Committee.The evaluations shall assess whether the aims of this Regulation of ensuring contestable and fair markets have been achieved and assess the impact of this Regulation on business users, especially SMEs, and end users. Moreover, the Commission shall evaluate if the scope of Article 7 may be extended to online social networking services.

3. 

The evaluations shall establish whether it is required to modify rules, including regarding the list of core platform services laid down in Article 2, point (2), the obligations laid down in Articles 5, 6 and 7 and their enforcement, to ensure that digital markets across the Union are contestable and fair. Following the evaluations, the Commission shall take  

appropriate measures, which may include legislative proposals.

4. 

The competent authorities of Member States shall provide any relevant information they have that the Commission may require for the purposes of drawing up the report referred to in paragraph 1.

Article 54

Entry into force and application

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the  

European Union.

It shall apply from 2 May 2023.

However, Article 3(6) and (7) and Articles 40, 46, 47, 48, 49 and 50 shall apply from 1 November 2022 and Article 42 and  

Article 43 shall apply from 25 June 2023.

Nevertheless, if the date of 25 June 2023 precedes the date of application referred to in the second paragraph of this Article,  

the application of Article 42 and Article 43 shall be postponed until the date of application referred to in the second  

paragraph of this Article.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
